The rules for using this website. Service agreements with clients are separate documents.
1. Acceptance
These Terms of Use govern your use of avynt.ai (the "Site"), operated by avynt ("avynt", "we", "us" or "our"). By using the Site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Using the site
You may use the Site to learn about our services and to contact us. You agree not to interfere with the Site's operation or security, not to submit false or misleading information through the contact form, not to send unsolicited commercial messages through it, and not to use automated tools to scrape the Site other than search engines following our robots.txt file. Security researchers who follow the responsible disclosure practice described on our Data Protection page are welcome.
3. Content and pricing
The information on the Site, including plan prices and the figures in our headline statistics, is provided for general information and is indicative only. It does not form an offer, and a service relationship with avynt begins only when both parties sign a written agreement that sets out scope, pricing and terms. We may change the Site and its content at any time.
4. Intellectual property
The Site, including the avynt name, wordmark, text, design and graphics, is owned by avynt or its licensors and is protected by copyright and trademark law. You may view and print pages for your own business evaluation of our services. Any other use requires our written permission. "Amazon" and the names of Amazon programs, and the names of third-party software mentioned on the Site, are trademarks of their respective owners; avynt is an independent company and is not affiliated with or endorsed by Amazon.
5. Client applications
The DSP App and the AFP Dispatch App linked from the Site are client applications made available to avynt clients under their service agreements and the terms presented inside each application. Access to those applications is restricted to authorized users, and these Terms of Use do not grant any right to use them.
6. Third-party services
The Site may link to third-party websites. We do not control them and are not responsible for their content or privacy practices. A link does not imply endorsement.
7. Disclaimer
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by law, avynt and its officers, employees and contractors will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (USD 100). Nothing in these terms limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules, and any dispute relating to the Site will be brought in the state or federal courts located in California. Service agreements with clients contain their own governing law and dispute resolution clauses, which prevail for matters they cover.
10. Changes
We may update these terms from time to time. The date at the top of this page shows when they last changed, and continued use of the Site after a change means you accept the updated terms.
